Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and RenoWise ("Company," "we," "our," or "us") regarding your use of the RenoWise mobile application and related services.

By accessing or using our service, you acknowledge that you have read, understood, and agree to be bound by these terms.

1. Eligibility and Account Registration

1.1 Age Requirement

You must be at least 18 years old to use RenoWise. By using our service, you represent and warrant that you meet this age requirement.

1.2 Account Creation

• You must provide accurate, current, and complete information during registration
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account
• We reserve the right to suspend or terminate accounts that violate these Terms

1.3 Account Types

• Free Account: Limited features and project capacity
• Premium Account: Full feature access with subscription fees
• Professional Account: Enhanced features for contractors and real estate professionals

2. Permitted Use and Restrictions

2.1 License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use RenoWise for personal or commercial renovation planning purposes.

2.2 Prohibited Activities

You agree NOT to:

• Use the service for any illegal purpose or in violation of applicable laws
• Attempt to gain unauthorized access to our systems or networks
• Interfere with or disrupt the service or servers
• Use automated systems (bots, scrapers) to access the service
• Reverse engineer, decompile, or disassemble the application
• Remove, alter, or obscure any proprietary notices
• Impersonate another person or entity
• Upload malicious code, viruses, or harmful content
• Use the service to send spam or unsolicited communications
• Collect or harvest user information without consent
• Resell or commercially exploit the service without authorization

2.3 User Content

• You retain ownership of property information and content you upload
• You grant us a license to use, store, and process your content to provide the service
• You represent that you have the right to upload and share all content you submit
• We reserve the right to remove content that violates these Terms or applicable laws

3. Cost Estimates and Disclaimers

3.1 Nature of Estimates

All cost estimates provided by RenoWise are approximate and for informational purposes only.

Estimates are formulated on a best-efforts basis using historical pricing data and market trends, regional cost multipliers and location factors, industry-standard calculation methodologies, and user-provided property information.

3.2 No Guarantee of Accuracy

• Actual renovation costs may vary significantly from estimates
• Estimates do not constitute quotes, bids, or contractual offers
• We do not guarantee the accuracy, completeness, or reliability of estimates
• Estimates are subject to change based on market conditions, material availability, and other factors

3.3 Third-Party Verification Required

Users are strongly advised to obtain multiple quotes from licensed contractors, conduct independent research and due diligence, verify all estimates with qualified professionals, and consult with architects, engineers, or specialists as needed.

3.4 Limitation of Liability for Estimates

RenoWise and its affiliates shall not be liable for discrepancies between estimated and actual costs, financial losses resulting from reliance on estimates, construction delays, cost overruns, or project failures, or quality of work performed by third-party contractors.

4. Contractor Connections and Third-Party Services

4.1 Contractor Listings

• RenoWise may connect you with third-party contractors and service providers
• We do not employ, endorse, or guarantee any contractors
• Contractor listings are provided for convenience only
• You are responsible for vetting, selecting, and contracting with service providers

4.2 Third-Party Relationships

• Contracts and agreements are solely between you and the contractor
• We are not a party to any transactions between users and contractors
• We are not responsible for contractor performance, quality, or disputes
• Verify licenses, insurance, and credentials independently

4.3 Reviews and Ratings

• User reviews reflect individual opinions and experiences
• We do not verify the accuracy of user-submitted reviews
• We reserve the right to remove fraudulent or inappropriate reviews

5. Subscription and Payment Terms

5.1 Premium Subscriptions

• Subscription fees are billed in advance on a recurring basis (monthly or annually)
• Prices are subject to change with 30 days' notice
• Current subscription prices are guaranteed for one year from the date of purchase and are reviewed annually
• You authorize us to charge your payment method for all subscription fees
• Failure to pay may result in service suspension or termination

5.2 Refund Policy

• Monthly subscriptions: No refunds for partial months
• Annual subscriptions: Pro-rated refunds available within 30 days of initial purchase
• No refunds for account terminations due to Terms violations
• Refund requests: support@renowise.app

5.3 Auto-Renewal and Cancellation

• Subscriptions automatically renew unless canceled
• Cancel anytime through Settings > Account > Manage Subscription
• Cancellation takes effect at the end of the current billing period
• Access continues until the end of the paid period

6. Intellectual Property Rights

6.1 Our Proprietary Rights

All content, features, functionality, designs, logos, trademarks, and technology are owned by RenoWise or our licensors and are protected by copyright, trademark, and other intellectual property laws.

6.2 Trademarks

RenoWise and associated logos are trademarks of our company. You may not use our trademarks without prior written consent.

6.3 Feedback and Suggestions

Any feedback, suggestions, or ideas you provide may be used by us without compensation or attribution.

7. Data Privacy and Security

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your personal information. By using RenoWise, you consent to our data practices as described in the Privacy Policy.

8. Disclaimer of Warranties

RenoWise is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties of accuracy, reliability, or completeness
• Warranties of uninterrupted or error-free operation
• Warranties that defects will be corrected

We do not warrant that the service will meet your specific requirements, results obtained from the service will be accurate or reliable, or the quality of any products, services, or information obtained will meet your expectations.

9. Limitation of Liability

To the maximum extent permitted by law:

9.1 Exclusion of Damages

RenoWise and its affiliates shall not be liable for indirect, incidental, special, consequential, or punitive damages; loss of profits, revenue, data, or business opportunities; cost of substitute goods or services; property damage or personal injury; or contractor performance or construction issues.

9.2 Cap on Liability

Our total liability for all claims related to the service shall not exceed the greater of $100 USD or the amount you paid us in the 12 months preceding the claim.

9.3 Exceptions

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability will be limited to the fullest extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless RenoWise, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses arising from your use or misuse of the service, your violation of these Terms, your violation of any rights of third parties, content you submit or upload, or your interactions with contractors or other users.

11. Dispute Resolution

11.1 Governing Law

These Terms are governed by the laws of Belgium, without regard to conflict of law principles.

11.2 Informal Resolution

Before filing a claim, you agree to contact us at legal@renowise.app to seek informal resolution.

11.3 Arbitration Agreement

Any disputes not resolved informally shall be resolved through binding arbitration rather than in court. Exceptions: small claims court matters, intellectual property disputes, injunctive relief requests.

11.4 Class Action Waiver

You agree to resolve disputes individually and waive the right to participate in class actions or collective proceedings.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the app with an updated "Last Modified" date. We will notify you of material changes via in-app notification and email. Your continued use of RenoWise after changes constitutes acceptance of the modified Terms.

13. Termination

13.1 Termination by You

You may terminate your account at any time through Settings > Account > Delete Account.

13.2 Termination by Us

We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent or illegal activities, abuse the service or other users, fail to pay subscription fees, or remain inactive for an extended period.

13.3 Effect of Termination

Upon termination, your right to use the service ceases immediately. We may delete your account data after 30 days (subject to legal retention requirements). Outstanding fees remain due and payable.
